Rushovich, Managing Partner, Rise Law Firm, PC. Last updated October 2026.

Rise Law Firm represents employees throughout the San Francisco Bay Area, including San Francisco, Oakland, San Jose, Berkeley, Fremont, Palo Alto and the surrounding communities of the Peninsula, the East Bay and the South Bay. We represent employees only, never employers, in cases involving wrongful termination, discrimination, harassment, retaliation and violations of California’s family and medical leave laws.

Our office is in Beverly Hills, and we represent employees throughout California. Most of our work with clients takes place by phone and video, and depositions are usually taken remotely, so a Bay Area employee receives the same representation as a client in Los Angeles without having to travel to meet us. When a hearing or trial must be attended in person, our attorneys appear in the Bay Area court where the case is filed.

We have secured millions of dollars for our clients, and we handle cases on a contingency basis: there are no fees or costs unless we recover compensation for you. If you were wrongfully fired or subjected to discrimination or harassment at work in the Bay Area, please contact us to request a free, confidential consultation.

What Employment Cases Do We Handle for Bay Area Employees?

Employees in San Francisco, Alameda, Santa Clara, San Mateo and Contra Costa Counties are protected by the same California statutes that protect employees in Los Angeles, including the Fair Employment and Housing Act (FEHA), the California Family Rights Act (CFRA) and the Labor Code’s whistleblower and anti-retaliation provisions. The cases we handle include the following (this list is not exhaustive):

Wrongful termination, including firings that violate public policy or follow a protected complaint or leave. See our wrongful termination page.

Retaliation and whistleblowing, where an employee is fired or demoted after reporting discrimination, harassment, unsafe conditions or a violation of law. See our retaliation and whistleblower pages.

Discrimination because of disability, pregnancy, age, race, gender, sexual orientation, gender identity or another protected characteristic. See our disability, pregnancy and age discrimination pages.

Sexual harassment and hostile work environment claims, discussed further below and on our hostile work environment page.

Failure to accommodate a disability or pregnancy-related condition, and failure to engage in the interactive process. See our reasonable accommodation page.

CFRA and FMLA leave violations, including denial of leave, interference and termination during or after leave. See our California CFRA leave guide.

Our practice focuses on employees who have been fired by employers with the resources to answer for their conduct, including large private companies and public agencies.

Where Are Bay Area Employment Cases Heard?

Most California employment claims begin with a complaint to the California Civil Rights Department (CRD), which issues a right-to-sue notice that allows the case to proceed in court. Under the FEHA’s venue provision (Government Code section 12965), a lawsuit may generally be filed in the county where the unlawful conduct occurred, where the employer keeps the relevant employment records, or where the employee would have worked but for the unlawful conduct. For Bay Area employees, that usually means one of the following courts:

San Francisco Superior Court, Civic Center Courthouse, 400 McAllister Street, San Francisco.

Alameda County Superior Court, René C. Davidson Courthouse, Oakland.

Santa Clara County Superior Court, Downtown Superior Court, San Jose.

San Mateo and Contra Costa County Superior Courts, for employees who worked on the Peninsula or in central and eastern Contra Costa County.

Some cases are filed in, or removed by the employer to, the United States District Court for the Northern District of California, which sits in San Francisco, Oakland and San Jose. Federal court is more likely when a complaint includes a federal claim or when the employer is based outside California. In deciding which claims to bring, we consider which forum is more favorable to the employee.

Representing Employees of Bay Area Companies and Public Agencies

The Bay Area economy is concentrated in technology, biotechnology, healthcare, finance and professional services, and many of its employers are large companies with sophisticated human resources and legal departments. Employees of these companies often face termination decisions that are presented as part of a reorganization, a reduction in force or a performance process. We examine whether the stated reason holds up, including who was selected, who made the decision, what the employee had recently reported or requested, and how comparable employees were treated.

We also represent employees of public employers, including cities, counties, transit agencies, school districts and public universities. Claims against public employers involve additional rules. For claims other than FEHA claims, a government claim must generally be presented to the agency within six months before a lawsuit may be filed, and public entities are not liable for punitive damages. Public employees should therefore speak with a lawyer promptly after a termination or other adverse action.

San Francisco Local Protections

Employees who work in San Francisco have additional rights under local ordinances. The Paid Parental Leave Ordinance requires employers with 20 or more employees to supplement California Paid Family Leave benefits for eligible employees taking up to eight weeks of leave to bond with a new child. The Family Friendly Workplace Ordinance allows eligible employees of employers with 20 or more employees to request a flexible or predictable work arrangement to care for a child or a family member age 65 or older, and requires the employer to provide it unless it would cause undue hardship. Both ordinances prohibit retaliation against employees who use these rights.

San Francisco also has its own minimum wage, which is higher than the state minimum, as well as ordinances on paid sick leave, employer health care spending, the use of criminal history in hiring (the Fair Chance Ordinance), lactation accommodation and pay parity (this list is not exhaustive). Many other Bay Area cities, including Oakland and San Jose, also set minimum wages above the state minimum.

Sexual Harassment in Bay Area Workplaces

The FEHA prohibits sexual harassment by supervisors, coworkers, clients and customers. Harassment is unlawful when it is severe or pervasive enough to alter the conditions of employment, and under California law a single incident can be sufficient if it is serious enough. Unwanted sexual comments, advances, touching, requests for sexual favors and misconduct directed at an employee because of gender are examples of harassment (this list is not exhaustive).

An employer is strictly liable for harassment by a supervisor who has supervisory authority over the employee, even if that supervisor is not the employee’s direct manager. For harassment by coworkers, the employer is liable if it knew or should have known of the conduct and failed to take immediate and appropriate corrective action. Retaliating against an employee for reporting harassment is a separate violation of the FEHA.

If you are being harassed, keep track of the dates and details of each incident, save messages and other documents, and report the conduct in writing if you can do so safely. For more information, see our sexual harassment page.

Deadlines and How We Work With Bay Area Clients

Employment claims are subject to strict deadlines. The following are the most common (this list is not exhaustive):

Claim

Deadline

FEHA complaint with the CRD (discrimination, harassment, retaliation, CFRA)

3 years from the unlawful act

FEHA lawsuit after a CRD right-to-sue notice

1 year from the notice

EEOC charge (federal claims)

300 days (the deadline for California employees)

Wrongful termination in violation of public policy

2 years

Labor Code section 1102.5 whistleblower retaliation

3 years

Government claim against a public employer (non-FEHA claims)

6 months

For a full discussion regarding deadlines where there has been a termination, see our page on termination-related deadlines.

When a Bay Area employee contacts us, we begin with a free, confidential consultation by phone or video. If we accept the case, we gather the employee’s documents electronically, handle the CRD complaint and any government claim, and prepare the case for filing in the appropriate Bay Area court. Our clients do not need to travel to Los Angeles at any stage, and depositions are usually taken remotely.

Frequently Asked Questions

Do I have a case?

You may have a case. If you were fired, demoted or harassed because of a protected characteristic, because you took protected leave, or because you reported or opposed unlawful conduct, you may have a claim under California law. Whether you have a case depends on the facts, including the timing of events and the reasons your employer gave. Contact us to request a free, confidential consultation.

Can a Los Angeles-based firm represent me in the Bay Area?

Yes. California employment law applies statewide, and our attorneys are licensed throughout California. We represent clients in Northern and Southern California, and most of our communication with clients takes place by phone and video.

Will I need to travel to meet with you?

No. We rarely meet clients in person, and depositions are usually taken remotely. If a hearing or trial requires your attendance, it will take place in the Bay Area court where the case is filed.

Do San Francisco employees have rights beyond state law?

Yes.
